Vince Guaraldi heirs sue Concord Music
The children of the late jazz pianist Vince Guaraldi, creator of the enduring holiday album "A Charlie Brown Christmas," have sued Concord Music Group, claiming the label has shortchanged them on more than $2 million in royalties. David and Dia Guaraldi's breach of contract action filed Dec. 23 in Alameda County Superior Court alleges that Concord and Fantasy Records, which was purchased by Concord in 2004, underpaid royalties "for years and perhaps decades." Echoing allegations of several recent actions -- the most recent of them filed last week by Peter Frampton and the heir of the Knack's drummer Bruce Gary (Daily Variety, Dec. 27) -- the suit also claims Concord "has impermissibly and without justification reduced the royalty paid on sales of digital downloadsby third parties." The filing states, "Particularly with regard to the 'Charlie Brown Christmas' albumFantasy Records issued statements containing false or deceptive representations and underpaid plaintiffs based on those inaccurate and incomplete accountings." "A Charlie Brown Christmas," which contains the yuletide hit "Christmas Time Is Here" and several recurring "Peanuts" cartoon themes, remains among the perennial holiday bestsellers. It stands at No. 37 on this week's U.S. album chart; according to Nielsen SoundScan, the collection has sold more than 3.1 million copies since the company began tracking sales in 1991. Action claims that royalty rates on record sales were "inaccurately low (at times, by as much as 70%)." Guaraldi was typically paid 50% of label receipts from third-party licensees. But, the suit says, "In calculating royalty rates on third party digital downloads, (Concord) has reduced by an additional 25% the already much lower royalty rate that would be payable on records sold by Concord Music's distributors." Bert Schneider dies at 78

CW Pushes Back Midseason Returns of Ringer, 90210

Now Nicita could be leaving. His contract expires at the end of December, and the company tells The Hollywood Reporter in a statement that "Rick and Jim have not discussed Rick's contract." Typically, such a deal is inked well in advance of expiration. A source with knowledge of the situation said that Nicita is considering his options, including production opportunities and a return to the representation business. During his time at CAA, Nicita ran the careers of Tom Cruise, Al Pacino and Nicole Kidman, among others. Nicita and Robinson declined to comment. The future of the once high-flying film company is unclear. Morgan Creek still has a distribution deal with Universal, though the pact is set to expire at the end of 2012. And the company, co-founded in 1988 by Robinson and Joe Roth, had been slated to produce Major League 3, but Robinson said in February that he wouldn't risk working with star Charlie Sheen in the aftermath of Sheen's erratic behavior. A planned Tupac Shakur biopic remains without a director after talks with John Singleton ended. Singleton would have replaced departed director Antoine Fuqua on the long gestating biopic, titled Tupac. And in November, Morgan Creek pulled out of co-financing Warren Beatty's Howard Hughes biopic. Dream House, the thriller that starred Daniel Craig, Rachel Weisz and Naomi Watts, was the first film released by Morgan Creek since Sydney White, which came out in 2007 and underperformed. Dream House grossed $21.3 million domestically, but cost $55 million and required reshoots. (Morgan Creek pre-sold the film internationally, which would have mitigated losses; Dream House made about $4 million overseas.) But its director, six-time Oscar nominee Jim Sheridan, unsuccessfully petitioned the Directors Guild of America to have his name removed from the project because he was displeased with the finished product, according to an OctoberLos Angeles Times story. Meanwhile, the company's international distribution arm, Bermuda-based Inverness Distribution Ltd., filed for bankruptcy protection in federal court in May, citing debts of up to $100 million. The company filed for bankruptcy after a sharp drop in royalty payments from the licensing of its films. Inverness holds the rights to such movies as The Last of the Mohicans and Young Guns. In court filings, Inverness said it was roughly $74 million in debt on a $150 million loan issued by Societe Generale, ING Bank NV and Bank of Ireland, among others. A company spokesman told THR in May that the bankruptcy could result in Morgan Creek losing certain distribution rights in some foreign territories on some of its older films. Maggie Q, Dillon Casey Nikita's midseaon finale left viewers with more than a few questions, and star Maggie Q sat down with reporters this month to tease what to expect once the show returns in January. Want some almost-nudity? Nikita new guy Dillon Casey, who plays Oversight's Sean Pierce, will be stripping down all in the name of the upcoming power play. "He's naked in the whole episode, the one that we just finished [shooting]," said Q. "There were a couple women on set who ... [placed] bets on how his body was underneath because he would wear suits all the time. Anyway, he strips down completely to his underwear for the whole episode. He gets tied to a chair with no clothes on. His body is amazing." From Nikita to Chuck: TV's sexiest crime fighters Tied to a chair? That sounds like an Amanda (Melinda Clarke) interrogation special to us! Check out what else is coming up for Nikita next year: Rogue family reunion. Alex (Lyndsy Fonseca) and Nikita won't always be at odds. "Alex is going to find out more about her family, which is going to move her in that direction again," said Q. "You are going to see them work together again. It's going to be lovely. There's such an older-sister-younger-sister dynamic that goes on. It's nice, and you're going to see some nice, tender moments with them too... and then you'll see them split apart again." Tomcat fight! Guardian Patrick Miller (William DeVry) is on the loose after Michael (Shane West) saved him and Nikita, but that's not the last we'll see of him. "We have some action stuff together that's really, really fun," said Q. "And apparently Devon [Sawa], Shane and him have a big fight that's coming up. Because it's hot. Every time the guys fight it's hot." Nikita lite. Fans of the show may have noticed that their favorite rogue agent hasn't been going mano a mano as much lately. That's because Q broke two of her fingers on set when a heavy grate fell on her hands. "We've been trying to go around the action right now with me for about three episodes because I've been healing," she said. "I just took my splints off last week so you can see my hands... We had to write it in to the episode you saw with Birkhoff. This SEAL is chasing me, and I grab this basketball to hit the cop with. I played the moment like, 'Ow!' So there's a Navy SEAL but somehow I hurt my hand on a basketball? It was all we could do because we had shot the rest of the stuff already." Nikita's Maggie Q offers hope for "Mikita" fans Amorous Amanda? We're still quaking from Amanda's interrogation of Birkhoff (Aaron Stanford), but apparently there's a softer side to her. "I think there's going to be some allusion to something between her and Percy," Q teased. An Oversight affair to remember. Nikita will have a long-awaited run-in with Oversight's Madeline Pierce (La Femme Nikita's Albert Watson)."It's coming up. It's going to be cool because Nikita hates her," said Q. Roan... revealed. The Division cleaner (Rob Stewart) has had much more screen time this season, and there's a reason for it. "Roan is absolutely involved with everything that's going on right now," said Q. "That will be revealed soon, how he's tangled up in this whole thing with Oversight." If we were Roan, we'd be after Nikita for that facial acid-scarring. Percy's master plan. Percy (Xander Berkeley) might be in that glaringly lit Division jail, but he's as dangerous as ever. "Percy is not stupid. He's not locked up in there doing nothing," said Q. "There's a lot of underhandedness... and we have some scenes coming up, which is really exciting. There are going to be a series of three episodes [Episodes 11-13] that run as a one big story line where everything seems to be converging and the impending implosion will happen. It's basically the web of Nikita, Division, Oversight, Percy, Alex -- everything kind of coming together and how tangled it's become and what's been bubbling under the surface that's going to happen." A new beginning. "Episode 13 is called 'Clean Sweep.' So 14 is a rebirth of everything that just exploded. Where they're going to go, we don't know." A finale fatality. What's a Nikita finale without a shocking death? "By the end of the season, yes, absolutely," said Q. "Honestly, by the end of the second season, you're going to be like, 'What?!?' Again." Zediva suspends operations
Internet streaming service Zediva is suspending operations after Hollywood studios won a permanent injunction prohibiting the company from streaming the latest homevideo releases from a bank of DVD players to its customers. U.S. District Judge John F. Walter issued the injunction on Friday, ruling that the company is "permanently restrained and enjoined" from using the copyrighted material unless it receives permission. Zediva had argued that its service was no different than a brick-and-mortar videostore, which rents movies without getting the permission of studios. In August, Walter granted a preliminary injunction to the studios and said that Zediva violated their right of public performance. He said that the company violated the "transmit" clause of the Copyright Act. The company altered its Web page with the word "intermission" bannered across the top and a message explaining that it was suspending operations. "A couple of years ago we came up with an idea for the next generation of DVD rentals," the message stated. "It seemed to us logical and evolutionary that if a customer was able to rent and play a DVD in his home, there should be no reason why he or she could not do that from the Internet cloud. After all, you can do that with a DVR, so why not with a DVD player? "While we hope to be back online soon, we don't know when (or whether) that will happen. We are disappointed by this turn of events, and that we are not permitted to serve you." MPAA senior VP-associate general counsel Dan Robbins said in a statement, "This result sends a strong message to those who would exploit the studios' works in violation of copyright law, on the Internet or elsewhere, and it is an important victory for the more than 2 million American men and women whose livelihoods depend on a thriving film and television industry." Studios worried that Zediva undercut their video windows with cable on-demand services as well as streaming outlets like Netflix, Amazon and Apple TV. "Those services pay the studios licensing fees for the right to stream movies, and those fees allow the studios to invest in new movies and compensate the writers, directors, actors, set designers, caterers, electricians and countless others whose work contributes to movies," Robbins said. New Clips From The Rum Diary
Johnny Depp demands to have some boozeIf you've read Hunter Thompson's The Rum Diary you'll know that while it's many things - riotous, chaotic, colourful - what it isn't is an obviously 'filmy' book. There's not a lot of conflict, little need for resolution and no big villain to have audiences hissing at the screen. Then again, something similar was said about Fear And Loathing In Las Vegas and that ended up winning a spot in cult movie heaven. This, we suspect, is where Bruce Robinson comes in. It's a hugely welcome return for the Withnail And I director, coaxed out of semi-retirement by Johnny Depp to write and direct. The humour and none-more-quotable patter that made Withnail great, combined with Thompson's acid prose, should make for a feast for fans of smart scriptwriting and blackly comic moments. These two new clips from the film, courtesy of Yahoo!Movies, set the scene for Paul Kemp's (Depp) arrival in the Puerto Rico town of San Juan, where he's due to start working for The San Juan Star.
